Booking, Payments & Cancellation Policies

1. Booking and Payment Schedule

  • Retainer Fee: A non-refundable retainer equal to 50% of the total contract amount is required to secure the event date and time slot.

  • Final Balance: The remaining balance is due in full exactly ten (10) calendar days prior to the scheduled event date.

  • Booking Priority: Dates are allocated on a strict first-come, first-served basis; last-minute bookings are subject to availability and immediate full payment.

2. Cancellation and Rescheduling

  • Late Cancellation: No refunds, credits, or transfers will be issued for cancellations made within ten (10) days of the event.

  • Standard Cancellation: Cancellations made ten (10) or more days prior to the event will result in the immediate forfeiture of the non-refundable retainer.

  • Rescheduling Credits: At the company's discretion, a partial or full credit may be granted for rescheduling a future date, subject to equipment availability.

3. Inclement Weather Policy

  • Weather Exemptions: Cancellations due to inclement weather are not accepted, as all carts are fully equipped for both indoor and outdoor placement.

  • Client Obligation: The Client must provide an alternate, covered indoor location in the event of severe or unseasonal outdoor weather conditions.

4. Travel and Logistics

  • Service Area: Operations are based locally out of Conroe, TX.

  • Travel Surcharges: Deliveries outside of a fifteen (15) mile radius from our base location will incur additional travel fees and may be subject to minimum booking requirements.

Safety & Equipment Policies

1. Mandatory Adult Supervision

  • Continuous Monitoring Required: The Client must provide continuous, uninterrupted adult supervision for the entire duration of the event.

  • Staff Exclusion: The Party Cart Coordinator is present solely to manage equipment and logistics.

  • No Custodial Duty: Party Cart staff shall not act as supervisors, caretakers, or chaperones for any guests under any circumstances.

2. Age-Appropriate Cart Selection

  • Client Assessment: The Client bears sole responsibility for evaluating and selecting a cart package that safely accommodates the developmental and age-appropriate levels of their specific guests.

  • Assumption of Risk: The Client assumes all risks associated with renting equipment that may not be suitable for the age groups present at the event.

3. Choking Hazards and Material Safety

  • Hazard Disclaimer: Carts contain small parts, components, and materials that may pose severe choking, ingestion, or physical hazards to children.

  • Liability Release: Party Cart by Allison LLC is entirely absolved of liability for any injury, illness, or medical incident resulting from guests—especially children—ingesting, misusing, or harming themselves with cart materials.

4. Allergy Precautions and Material Disclosures

  • Precautionary Duties: The Client holds full responsibility for identifying attendee food or material allergies and implementing necessary safety protocols.

  • Ingredient Transparency: Detailed ingredient or material composition sheets are available upon written request.

  • Indemnification: The Client shall indemnify Party Cart by Allison LLC against any claims or medical expenses arising from allergic reactions occurring at the event.

5. Equipment Damage and Negligence Recovery

  • Property Protection: The Client is strictly liable for any physical damage, loss, or theft incurred by the cart or its materials during the rental period.

  • Negligence Coverage: This liability covers actions caused by the negligence, recklessness, or intentional acts of the Client, their guests, or event attendees.

  • Financial Reimbursement: The Client agrees to fully reimburse Party Cart by Allison LLC for the retail cost of equipment repair or total replacement within 14 business days of the incident.
